BOARD MEETING – June 5, 2007

1.             CALL TO ORDER

Vice President Treece called the meeting to order at 6:00 p.m. in the Board Room at the MDUSD Dent Center.

 

PUBLIC COMMENT: None

 

CLOSED SESSION:  The Board adjourned to Closed Session at 6:01 p.m. in Room 6 of the Dent Center. Topics discussed included 5 expulsion cases; existing litigation (Spieler v. MDUSD); and negotiations.

 

2.             RECONVENE OPEN SESSION:  Hearing that a large number of teachers might be attending this meeting, the Board scheduled Open Session in the Multi-use Room at Monte Gardens Elementary School. At 7:31 p.m. the Board adjourned from Closed Session to the school for the Open Session. President Eberhart led the Pledge of Allegiance to the Flag.

 

                Expulsions:

Student 63-07: Strange moved, Allen seconded, and the Board voted 5-0-0 that Student 63-07 be expelled from all schools programs of the Mt. Diablo Unified School District and that Student 63-07 may apply for readmission after January 25, 2008.  It is required that Student 63-07 participate in individual counseling, community service, the COPS program, the District’s Teen Anger Management Workshop, and show evidence of a successful school experience, prior to applying for readmission.

 

Student 64-07: Allen moved, Mayo seconded, and the Board voted 5-0-0 that Student 64-07 be expelled from all schools programs of the Mt. Diablo Unified School District and that Student 64-07 may apply for readmission after January 25, 2008.  It is required that Student 64-07 participate in individual counseling, community service, the COPS program, and show evidence of a successful school experience, prior to applying for readmission.

 

Student 65-07: Mayo moved, Treece seconded, and the Board voted 5-0-0 that Student 65-07 be expelled from all schools programs of the Mt. Diablo Unified School District and that Student 65-07 may apply for readmission after January 25, 2008.  It is required that Student 65-07 participate in individual counseling, community service, the COPS program, and show evidence of a successful school experience, prior to applying for readmission.

 

Student 66-07: Treece moved, Mayo seconded, and the Board voted 5-0-0 that Student 66-07 be expelled from all schools programs of the Mt. Diablo Unified School District and that Student 66-07 may apply for readmission after January 25, 2008.  It is required that Student 66-07 participate in individual counseling, community service, the COPS program, the District’s Teen Anger Management Workshop, and show evidence of a successful school experience, prior to applying for readmission.

 

Student 67-07: Allen moved, Treece seconded, and the Board voted 5-0-0 that Student 67-07 be expelled from all schools programs of the Mt. 3.             CONSENT AGENDA

Allen moved, Treece seconded, and the Board voted 5-0-0 to adopt the Consent Agenda, thereby approving the following items:

3.2.2 Resolution 06/07-107 Education Code 44258.2 – Board Authorization

Adopted Resolution #06/07-107, authorizing 12 teachers, who hold a single subject or secondary credential and have 12 lower division units or 6 upper division units in a subject, to teach that subject in a middle school for the 2007-08 school year, as per  Ed. Code 44258.2.

 

3.2.3 Resolution 06/07-108 Education Code 44263 – Board Authorization

Adopted Resolution #06/07-108, authorizing 7 teachers who hold a California teaching credential and have 18 lower division units or 9 upper division units or graduate coursework in a subject to teach that subject for the 2007-08 school year, as per Ed. Code 44263.

 

3.2.4 Resolution 06/07-109 Education Code 44256(b) – Board Authorization

Adopted Resolution #06/07-109, authorizing 5 teachers, who hold a multiple subject or elementary credential and have 12 lower division or 6 upper division units in a subject to teach that subject in a middle school for the 2007-08 school year, as per Ed. Code 44256(b).

 

3.2.5 Recommendation for Professional Clear Education Specialist: Mild/Moderate Teaching Credential with English Learner Authorization (pending approval)

Recommended Joseph Harrison for a Professional Clear Teaching Credential as he has completed a three-year District Intern Program.

 

3.2.6 Recommendation for Preliminary Single Subject: English with English Learner Authorization

Recommended Kari Barney for a Preliminary Teaching Credential as she has completed a two-year District Intern Program.

 

3.2.7 Internship Credential Program Agreement with National University

Approved a student teaching agreement with National University. In order for a teacher to participate in an internship program, there must be an agreement or memorandum of understanding on file between the District and the institution providing the internship program.

 

3.3          Classified Personnel

3.3.1 Leaves of Absence, Resignations, Retirements, Employment

 

3.3.2 Elimination of One (1) Part-time Instructional Assistant-Bilingual Position at Oak Grove Middle School

Eliminated one (1) vacant 32.5-hour/week, school-day-only, Instructional Assistant-Bilingual position at Oak Grove Middle School. The leadership of CSEA was advised of the proposed elimination. Fiscal Impact: Savings of $34,120 to Title I.

 

3.3.3 Elimination of One (1) Vacant Full-Time Senior Account Clerk Position and Creation of One (1) Full-Time Payroll Analyst Position in Payroll

Eliminated one (1) vacant, full-time, 12-month Senior Account Clerk position and created one (1) full-time, 12-month Payroll Analyst position in the Payroll Department. This position will satisfy part of the Fiscal Crisis Management Assistance Team (FCMAT) recommendations and supports the District’s goal of improving and enhancing payroll services and functions. Fiscal impact: $24,397 for fiscal year 2007-08.  Funding source: General Fund

 

3.3.4 Creation of a New 3.0 Hour PM Custodian Position

Created a 3-hour (.375 FTE) Custodian PM position to address the on-going housekeeping needs at the Diablo Day Program at Willow Creek Center. Fiscal Impact: $14,528.  Funding Source: General Fund

 

3.3.5 Creation of Two (2) Part-Time Instructional Assistant-Bilingual Positions at Glenbrook Middle School

Created two (2) 30-hour/week, school-day-only, Instructional Assistant-Bilingual positions at Glenbrook Middle School. Fiscal impact: $67,146 for fiscal year 2007-08.  Funding source: General Fund (allocation provided to Underperforming Schools)

 

3.4          Resolution 06/07-110 to Authorize Year-End Intra-Budget Transfers

 

3.5          Amendment to Contract with Charles Ham Associates

Approved amendment totaling $164,118.85 to contract with Charles Ham Associates for architectural services for the Measure C Construction Program at Ayers, Monte Gardens, Silverwood and Westwood elementary schools and Shadelands and Sunrise Centers. Amendment is for additional design services related to assorted projects at these sites. Funding Source: Measure C

 

3.6          Change orders

3.6.1 Final Change Order to Bid 1400/Contract C-829 in the amount of $1,378 to NBC General Contractors, Inc. for the modernization and new classrooms at Pleasant Hill Education Center. Funding Source: Measure C

 

3.6.2 Final Change Order to Bid 1450/Contract C-847 in the amount of $22,693.30 to Kel Tec Builders, Inc. for the renovations to Willow Creek Center. Funding Source: Proposition 55 funds.

 

3.7          Final Deductive Change Order to Bid 1408/Contract C-826

Final deductive change order to Bid 1408, Contract C-826 in the amount of ($19,632.98) to Shared Technologies, Inc. for the installation of new telephone systems at Hidden Valley, Holbrook, Highlands, and Mt. 3.8          Award of Bids

3.8.1 Award of Bid 1470 to Biland Construction Company in the amount of $464,000 to provide the electrical upgrades, Group 5, at Silverwood, Strandwood and Westwood elementary schools. Funding Source: Measure C

 

3.8.2 Award of Bid 1471 to River Electric in the amount of $122,095 to provide the electrical upgrades, Group 5, at Shadelands Elementary School. Funding Source: Measure C

 

3.9          Notices of Completion

3.9.1 Notice of Completion to Contract C-826, Bid 1408 to Share Technologies, Inc., in the amount of $158,246.63, for the new telephone systems at Hidden Valley, Holbrook, Highlands, and Mt. 3.9.4 Notice of Completion to Contract 843, Bid 1435 to Nema Construction, in the amount of $395,000, for the new intercom system at Sequoia Middle School. Funding Source:  Deferred Maintenance

 

3.9.5 Notice of Completion to Contract 847, Bid 1450 Kel-Tec Builders, Inc., in the amount of $733,142.65, for renovations to Willow Creek Center to house Diablo Day School. Funding Source:  Proposition 55

 

3.10  CIF/North Coast Representatives for Mt. Diablo Unified School District High Schools 2007-08

Ratified the positions of principal, vice principal, and athletic director from Concord, Clayton Valley, College Park, Mt. Diablo, Northgate, and Ygnacio Valley high schools to serve as 12 representatives to California Interscholastic Federation North Coast Section for the 2007-2008 school year.

 

3.11  Food and Nutrition Services

Approved request from Food and Nutrition Services Department to issue purchase orders/contracts for food, beverages and delivery services to students in Kindergarten through grade 12. Fiscal Impact:  Projected expense not to exceed $4,566,000 for the 2007-2008 school year. All expenses covered by the Cafeteria Fund.

 

3.12  Renewal of Contract with David Costa

Approved renewal of the Food and Nutrition Services contract with David Costa, who picks up cash and related documents from the cafeteria or office sites and delivers them to Bank of America. He is bonded and insured. Fiscal Impact: Projected expense not to exceed $37,000 for the 2007-2008 school year. Funding Source: Cafeteria Fund, already budgeted.

 

4.             RECOGNITIONS -

4.1          Coach of the Year 2007

McHenry announced that the District has instituted a new award, Athletic Coach of the Year, which is being presented at this meeting. He introduced retired coach Bud Beemer, who headed the selection committee, which was comprised of athletic directors, coaches,  other staff. and parents. McHenry listed the criteria for the award: “The individual should teach honesty and integrity, promote sportsmanship and fair play, have a commitment to excellence, and work hard to prepare student athletes to perform at the highest level.” The criteria is not about winning, he said, but about the kind of coach who has those values. He then announced the first recipients of the honor:

·          Coach of the Year – Women’s: Verna Ogden, Tennis, Northgate High School

·          Coach of the Year – Men’s: Dennis Bledsoe, Water Polo, Clayton Valley High School

President Eberhart presented the honorees with a plaque and an athletic jacket in recognition of their achievement.

 

4.2          State of California Distinguished Schools

The Board recognized the staff and parents at the four secondary schools that were each named a 2007 California Distinguished School. On behalf of the Board, President Eberhart presented each with a plaque.

5.             BOARD FORUM -

This item is here for the Board of Education to discuss any issues of concern.

 

Eberhart explained that Board reports, which had traditionally been presented at the end of each meeting, were being moved up on the agenda on a trial basis. He said the impetus for the move came from a teacher’s suggestion. The Board will use this format through the end of the school year and then decide whether to continue with it.

 

5.1          Committee Minutes: None

 

5.2          Board Reports

Mayo said she’d visited four elementary schools, the dedication of the Robert Shearer (formerly Gregory Gardens) Pre-School and mural; the Bridge School graduation; the “outstanding” Young Authors Gala; and the Serendipity program’s end-of-year dinner at Centre Concord. She congratulated Alejandro Martinez, a Serendipity student recently elected vice president of the state FHA HERO program.

 

Allen announced that the Concord Rotary awarded seven $1,500 scholarships to Serendipity students at the end-of-year dinner. Earlier today he judged Northgate senior projects and attended the end-of-year BTSA Colloquium. He acknowledged the work of the teacher coaches for the BTSA/PAR program. He reported that the City of Concord will hold another community meeting on June 16 to hear ideas for the kinds of development community members want to see on the Concord Naval Weapons Station property.

 

Treece said she attended the first meeting of the Naval Weapons Station Technical Advisory Group (TAG) as representative of the industry-led Contra Costa Council. Dick Nicoll also attended representing MDUSD. She also attended the Young Authors Gala, a “thrilling” opportunity to see and hear student work; a meeting of the Budget Advisory Committee meeting led by Gloria Gamblin and with parents, community members, and staff “rolling up their sleeves to look at the budget process from the state on down”; the BTSA Colloquium, where she was impressed with the teacher work on display. As a representative of industry and workforce development on the county’s P16 Council, she recently attended a meeting at which Evie Groch and Susan Hukkanen of MDUSD’s Curriculum and Instruction Department clearly explained the Single Plan for Student Achievement to business and higher education leaders.

 

Strange commented that as the newest Board member, he has been educating himself on the District. For the past two months he has been researching “where we stand as a District” in terms of revenues and salaries. He then presented some of the data he’s collected. Highlights include.

A.       Questions:

          From a revenue perspective, is Mt. Diablo similarly situated to surrounding districts?

          How does Mt. Diablo’s revenue compare to other Contra Costa County unified districts?

          Is it fair to compare Mt. Diablo to Alameda County districts?

          How does Mt. Diablo’s teacher salary schedule compare to other Contra Costa County unified districts?

D.      Conclusions

          Mt. Diablo has the lowest available revenue of Contra Costa County unified districts.

          It is unfair to compare Mt. Diablo to Alameda County unified districts due to huge revenue discrepancies.

          The District has a teacher benefit problem, not a teacher salary problem.

          Everyone must get together to solve the revenue problem.

          The District needs a parcel tax to be competitive.

 

5.3  Issues of Concern: None voiced

 

6.             PUBLIC COMMENT

Lorie Strunk, parent whose son was expelled by Board vote earlier in the meeting, complained about the school staff’s handling of her son’s tardiness, behavioral issues, and education and about its communication with her.

A number of teachers spoke on the need for teachers to be paid higher salaries and receive District-paid medical benefits: Judith Cubillo, Shoshana Nurik, Paula Oesterling, Anita Johnson, Margie Balch, Elaine Murphy, Mark MacKusik, Carolyn Miller Pope, Laurel Palmer, Anna Davis, and Jennifer Smith.

Several parents spoke on the teacher salary issue: John Parker, Measure C and Parent Advisory Council member, said everyone in the District works hard and encouraged people to heed the words one of the GATE poets read earlier in the meeting: see each other’s point of view. Mona Ricard, president-elect of the Mt. Diablo Council PTA and teacher, encouraged all to work together to lobby Sacramento for better education funding. Mary Gray, Pleasant Hill Education Commission, said teachers need better salaries. Helene Munoz supported both class size reduction and medical benefits for teachers. David Farabee urged the Board to find a way to keep young teachers in the district.

Students: Ray Triana and Devin Munoz, Pleasant Hill Elementary, spoke in favor of raises for teachers and more classroom assistants. Vivian Wong and other Northgate students expressed concern about the number of teachers leaving their school.

Eberhart expressed appreciation for the comments made tonight, for people attending the meeting and sending messages to him and other Board members.

 

7.             COMMUNICATIONS: ORGANIZATIONS

Mike Noce, MDEA president, thanked teachers for attending the meeting and speaking to the Board. He said the union and the District can move toward a positive relationship if the District would do the following: offer a competitive compensation package, work with MDEA on Program Improvement schools (QEIA), fill teacher vacancies more quickly, stop spending money on programs away from the classroom, allocate the full Cost Of Living Adjustment (COLA) and more of the Ending Fund Balance in the District budget to salaries, go back to the collaborative practices of former MDUSD superintendent Paul Allen, and reprioritize District funding.

 

Board comment   Eberhart remarked that Noce’s comments about working together “ring true to me.” He said it’s important to understand that two pieces make up total compensation: benefits and salary. The Board has had to define where compensation is falling down, and it’s clearly in regard to medical benefits. He noted that teachers want “more than average,” and urged them to work collectively to define “average.” He expressed hope that teachers are telling the MDEA leadership to work collaboratively with the District as it’s important for negotiations teams to share ideas, to work across the table.

 

8.             REPORTS/INFORMATION: Literary Magazine, Between the Lines

Coleen Dowd, a program specialist who coordinates the Gifted And Talented Education (Gate) program, introduced three students who were instrumental in producing this year’s literary magazine Between the Lines: Kelly Andrews, Pleasant Hill Middle School, who described how she designed the cover art; Madison Day, Valley View Middle, who read aloud the title poem, which she wrote; and Gerilyn Knick, Riverview Middle, who read aloud the book’s final poem, which she wrote. Dowd said the annual magazine is part of the enrichment program for GATE middle schools students, who write, edit, and select the poems to be published.

McHenry noted that there are eight days left until end of school and encouraged everyone to “put any differences aside and celebrate with students.

Treece moved, Strange seconded, and the Board voted 5-0-0 to appoint Katie Gaines as Director, Alternative Education, effective July 1, 2007.

 

10.2    Appointment of Vice Principal, High School

Strange moved, Treece seconded, and the Board voted 5-0-0 to appoint Irene Keenan as Vice Principal, High School, assigned to College Park, effective July 1, 2007.

 

10.3    Appointment of Vice Principal(s), Elementary School

Mayo moved, Treece seconded, and the Board voted 5-0-0 to appoint Nina Mucher as Elementary Vice Principal, assigned to Sun Terrace Elementary, effective July 1, 2007.

 

Allen moved, Strange seconded, and the Board voted 5-0-0 to appoint Christina Topf as Elementary Vice Principal, assigned to Hidden Valley Elementary, effective July 1, 2007.

 

Allen moved, Strange seconded, and the Board voted 5-0-0 to appoint Monica Moreno as Elementary Vice Principal, assigned to Rio Vista Elementary, effective July 1, 2007.

 

Strange moved, Treece seconded, and the Board voted 5-0-0 to appoint Nigel Dabby as Elementary Vice Principal, assigned to Delta View Elementary, effective July 1, 2007.

 

10.4    Appointment of Coordinator, Student/Community Services 9-12

Mayo moved, Strange seconded, and the Board voted 5-0-0 to appoint Julene MacKinnon as Coordinator, Student/Community Services 9-12, effective July 1, 2007.

 

10.5    Appointment of Coordinator, Student Services 6-8

Treece moved, Allen seconded, and the Board voted 5-0-0 to appoint Micah Rodriguez as Coordinator, Student Services 6-8, assigned to Valley View Middle School, effective July 1, 2007.

 

10.6    Contract Between Mt. Diablo Unified School District and Paradigm HealthCare Services, Inc.—PULLED

 

10.7    Adoption of Studio Art AP Course of Study

Strange moved, Allen seconded, and the Board voted 5-0-0 to adopt the Studio Art AP course of study as recommended by a committee of high school teachers working with a curriculum specialist. Presented as information at the May 22 meeting, this item was returned for action at this time.

 

10.8    Consider Allocation of Lottery Funds for the 2007-2008 School Year

Staff recommended that $100,000 of the 2007-2008 lottery funds be used to purchase storage sheds to be placed at school sites. The cost of a 12 x 32 storage shed is estimated to be approximately $10,000 or less.

 

Board comment   Eberhart said he would like the Board to have a broad discussion on the allocation of lottery funds, which have been used in the recent past “to stop the bleeding” from budget cuts. As the funds are Unrestricted General Fund money, he would like to keep them unspent until after contract negotiations are completed. In regard to the “Tuff Shed” listed on this agenda item, he said it is neither long-lasting nor vandalism-proof. He suggested turning the unused shower areas in school gyms into storage space.

 

Board actions   Strange moved, Eberhart seconded, and the Board voted 2-3 (Allen, Mayo, Treece, no; motion defeated) to table the item until the next meeting for a further discussion on how all lottery funds are allocated.

 

Allen moved, Mayo seconded, and the Board voted 2-3 (Eberhart, Strange, Treece, no; motion defeated) to allocate $100,000 of lottery funds to purchase storage sheds on school sites.

 

10.9    Adopt Revised Job Description for School Bus Driver Instructor

Strange moved, Treece seconded, and the Board voted 5-0-0 to adopt the job description for School Bus Driver Instructor, which was updated to describe the current duties and responsibilities more accurately. The position will remain at Range 1 of the Management Salary Schedule.

 

10.10      Opportunity for Public Response to Public Employees Union, Local One’s (CST) Additional Successor Agreement Proposals

At the May 22, 2007, Board meeting, Public Employees Union, Local One (Clerical, Secretarial and Technical Unit) publicly presented additional Successor Agreement proposals. These proposals were presented for public response at this time.

 

Public hearing   Eberhart opened the public hearing at 10:15 p.m. Receiving no requests to speak, he closed the hearing.

 

10.11      Board Policy 6112 – Instruction, School Day

Staff has updated Board Policy 6112, “Instruction, School Day,” to reflect California School Board Association language. The revised policy allows high schools to continue the practice of providing qualified seniors the opportunity to have a five-period day. Presented only as information at this time, this item will be returned for action at a subsequent meeting.

 

10.12      Board Policy/Administrative Rule 5121 – Grades/Evaluation of Student Achievement

Staff has updated Administrative Rule 5121, “Grades/Evaluation of Student Achievement,” to reflect California School Board Association language. The revised rule clarifies language regarding grading, enrollment in advanced placement courses, and withdrawal from classes. It was reviewed by high school department chairs, principals, and co-administrators and the Educational Services Department. Presented only as information at this time, this item will be returned for action at a subsequent meeting.

 

10.13      Adoption of Updated Advanced Spanish, Spanish AP, and Spanish Honors Courses of Study

A committee of high school Spanish teachers working with a curriculum specialist has updated and renamed the courses of study for Advanced Spanish, Spanish AP, and Spanish Honors pursuant to the College Board and U.C. guidelines. Presented only as information at this time, this item will be returned for action at a subsequent meeting.

 

10.14      Adoption of the Updated French IV AP and French V Honors Courses of Study

A committee of high school French teachers working with a curriculum specialist has updated and renamed the courses of study for French IV AP and French Honors pursuant to the College Board and U.C. guidelines. Presented only as information at this time, this item will be returned for action at a subsequent meeting.

 

10.15      Adoption of the Updated German IV AP Language, German V Honors, and German VI Courses of Study

Two high school German teachers working with a curriculum specialist has updated and renamed the courses of study for German IV AP (Language), German V Honors, and German VI pursuant to the College Board and UC guidelines. 10.16      Adoption of Elementary Music Textbook

Public hearing   Eberhart opened the public hearing at 10:20 p.m. Jerry Okendo, parent and chair of the local League of United Latin American Citizens (LULAC), said the address listed in the Parent Information Packet (PIP) for the Office of Civil Rights needs to be corrected. With no other requests to speak, Eberhart closed the public hearing.
